About our privacy policy

Lavinta cares greatly about your privacy. We therefore exclusively process data that we need for (improving) our services, and we handle the information we have gathered about you and your use of our services with care. We never make your data available to third parties for commercial purposes.

This privacy policy applies to the use of the website and the services provided by Lavinta. The starting date for the validity of these terms is 29/10/2021; with the publication of a new version the validity of all previous versions is cancelled. This privacy policy describes what information about you is collected by us, what this data is used for, and with whom and under what conditions this data could be shared with third parties. We also explain to you how we store your data, how we protect your data against misuse and what rights you have regarding the personal data you provide us.

About our data processing

Below you can read how we process your data, where we store it, what security techniques we use and to whom the data is visible.

Our webshop has been developed using Shopify software. Personal data that you make available to us for the purpose of our services is shared with this party. Shopify requires access to these details to offer us (technical) support and will never use this data for any other purpose. Based on the agreement we have concluded with them, Shopify is obliged to take appropriate security measures. Shopify uses cookies to gather technical information about your use of the software; no personal data is gathered and/or stored.

Webhosting

We use webhosting and email services provided by Shopify. Shopify processes personal data on our behalf and does not use your data for its own purposes. This party can, however, collect metadata about the use of its services. This is not personal data. Shopify has taken appropriate technical and organisational measures to prevent loss and unauthorised use of your personal data. Shopify is bound by a duty of confidentiality under the agreement.

For our regular business email we use the email services of Shopify. This party has implemented fitting technical and organisational measures to prevent misuse, loss and corruption of your data and ours as far as possible. Shopify does not have access to our mailbox and we treat all our email traffic confidentially.

Payment processors

For handling (part of) the payments in our webshop we use the platform of Shopify Payments. Shopify Payments processes your name, address and residence information and your payment details such as your bank account or credit card number. Shopify Payments has taken appropriate technical and organisational measures to protect your personal data. Shopify Payments retains the right to use your (anonymised) data to further improve its services and, in that context, to share data with third parties. In the case of a request for a deferred payment (credit facility), Shopify Payments shares personal data and information relating to your financial position with credit rating agencies. All the aforementioned guarantees regarding the protection of your personal data also apply to the parts of Shopify Payments' services for which it engages third parties. Shopify Payments does not store your data for longer than is permitted under the statutory terms.

Reviews

We gather reviews via the WebwinkelKeur platform. If you leave a review via WebwinkelKeur you are required to provide a name and email address. WebwinkelKeur shares this data with us so that we can match your review to your order. WebwinkelKeur also publishes your name on its own website. In some instances WebwinkelKeur can contact you to ask you to clarify your review. If we invite you to leave a review, we share your name and email address with WebwinkelKeur. They use this information with the sole purpose of inviting you to leave a review. WebwinkelKeur has taken appropriate technical and organisational measures to protect your personal data. WebwinkelKeur retains the right to engage third parties in order to provide its services; we have given WebwinkelKeur permission to do so. All the aforementioned guarantees regarding the protection of your personal data also apply to the parts of the services for which WebwinkelKeur engages third parties.

Transport and logistics 

If you place an order with us it is our task to have your parcel delivered to you. In most cases we use the services of DPD and FedEx to carry out the deliveries. For that purpose it is necessary that we share your name, address and residence information with DPD and FedEx.  DPD and FedEx use this information solely for the purpose of performing the agreement. In the event that DPD and FedEx engage subcontractors, DPD and FedEx also make your data available to those parties.

Invoicing and accounting

For our administration and bookkeeping we use the services of Shopify. We share your name, address and residence information and details relating to your order. This data is used for the administration of sales invoices. Your personal data is transmitted and stored securely. Shopify is bound by a duty of confidentiality and will treat your data confidentially. Shopify does not use your personal data for purposes other than those described above.

External sales channels

General purpose of processing Purpose of data processing

We use your data with the sole purpose of providing our services. This means that the purpose of processing this data always stands in direct relation to the assignment you give us. We do not use your data for (targeted) marketing. If you share information with us and we use this information to contact you at a later time other than at your own request, we will first ask for your explicit consent. Your data is not shared with third parties for any purpose other than to fulfil accounting and other administrative obligations. These third parties are all bound by a duty of confidentiality on the basis of the agreement between them and us, an oath or a legal obligation.

Automatically collected data

Data automatically gathered by our website is processed with the purpose of further improving our services. This data (for instance your IP address, web browser and operating system) is not personal data.

Cooperation in tax and criminal investigation

In some cases Lavinta may be obliged, on the basis of a legal obligation, to share your data in connection with a fiscal or criminal investigation by the authorities. In such a case we are forced to share your data, but we will oppose this within the possibilities the law offers us.

Retention periods

We store your data for as long as you are a client with us. This means that we maintain your client profile until you make it known to us that you no longer wish to use our services. We will also treat such a message as a request to be forgotten. On the basis of applicable administrative obligations we are required to keep invoices containing your (personal) data; we will therefore store this data for as long as the applicable term runs. Personnel, however, no longer have access to your client profile or to documents we produced in response to your assignment.

Your rights

Based on the applicable Dutch and European legislation you, as a concerned party, have certain rights regarding the personal data processed by us or on our behalf. Below we explain what these rights are and how you can invoke them. In principle, to prevent abuse, we only send statements and copies of your data to the email address already known to us. Should you wish to receive the data at another email address or, for instance, by post, we will ask you to identify yourself. We maintain an administration of concluded requests; in the case of a request to be forgotten we administer anonymised data. You receive all statements and copies of data in the machine-readable data format that we use within our systems. At all times you maintain the right to lodge a complaint with the Autoriteit Persoonsgegevens (the Dutch Data Protection Authority) if you suspect that we are using your personal data in the wrong way.

Right of inspection

At all times you have the right to view the data that we process, or have processed, that relates to your person or may be reduced to it. You may submit a request to that effect to our contact in charge of privacy matters. You will receive a response to your request within 30 days. If your request is approved we will send you, at the email address known to us, a copy of all data together with an overview of the processors managing this data, mentioning the category under which we have stored this data.

Right to rectification

At all times you have the right to have the data that we process, or have processed, that relates to your person or may be reduced to it, adjusted. You may submit a request to that effect to our contact in charge of privacy matters. You will receive a response to your request within 30 days. If your request is approved we will send you, at the email address known to us, a confirmation that the data has been adjusted.

Right to restriction of processing

At all times you have the right to restrict the data that we process, or have processed, that relates to your person or may be reduced to it. You may submit a request to that effect to our contact in charge of privacy matters. You will receive a response to your request within 30 days. If your request is approved we will send you, at the email address known to us, a confirmation that the data will no longer be processed until you lift the restriction.

Right of transferability

At all times you have the right to have the data that we process, or have processed, that relates to your person or may be reduced to it, processed by another party. You may submit a request to that effect to our contact in charge of privacy matters. You will receive a response to your request within 30 days. If your request is approved we will send you, at the email address known to us, statements or copies of all data about you that we have processed or that has been processed by other processors or third parties on our instructions. In all likelihood we will no longer be able to continue our services in such a case, because the secure linking of data files can then no longer be guaranteed.

Right of objection and other rights

In some cases you have the right to object to the processing of your personal data by Lavinta or on its instructions. If you object we will immediately cease processing your data pending the handling of your objection. If your objection is justified we will make statements and/or copies of the data that we process, or have processed, available to you and permanently cease processing thereafter. You also have the right not to be subjected to automated individual decision-making or profiling. We do not process your data in such a way that this right applies. If you believe that it does, please contact our contact in charge of privacy matters.

Cookies

Google Analytics

Cookies from the American company Google are placed via our website as part of the “Analytics” service. We use this service to track and obtain reports on how visitors use the website. This processor may be obliged, under applicable laws and regulations, to give access to this data. We collect information about your browsing behaviour and share this data with Google. Google can interpret this information in combination with other data sets and thereby track your movements on the internet. Google uses this information to offer, among other things, targeted advertising (Adwords) and other Google services and products.

Third-party cookies

If software solutions from third parties use cookies, this is stated in this privacy statement.

Privacy policy changes

We reserve the right to change our privacy policy at any time. On this page, however, you will always find the most recent version. If the new privacy policy has consequences for the way in which we process data already collected about you, we will notify you of this by email.
